A Close Look On Patent Versus Trademark

Intellectual Property Rights are laws that concern original creations like writings, inventions, or artistic works. Patent and trademarks are a part of the intellectual property rights and refer to inventions and brand names. The patent refers to giving rights to the people which come up with innovations. In order to receive a patent, the innovation has to be useful, relevant to the public and industry, original, and, of course, it has to function. Inventors can obtain permanent rights as long as they make their inventions open to the public.

There are three types of patents people can obtain:

1. Plant patent- it refers to plants which are created through asexual reproduction. Everybody who makes a new variety of plants will receive a plant patent. 2. Utility patent- it refers to technology and inventions that have to do with mechanisms, piece of manufacture or machines which contribute to industrial and economical development. 3. Design patent- this patent refers to designs and is given to anyone who creates a unique, useful, and new design for an article of manufacture.

Trademarks are a sort of signature used by different companies on their products. They are used by companies in order to eliminate confusion when people are buying certain products. Trademarks usually are names, symbols, or images that give a company exclusive rights for the use of a mark while patent gives you the right to deny people to use, sell, or recreate your invention.

The universal rule for patents is that they are public and can be used by people. However, only the inventors benefit from selling or distributing them. With trademarks there is another story, they are used as an image and advertising method. With a good trademark people will be protected from any frauds. The same thing applies to patent, where people are protected from illegal use of their inventions.

Any inventor can sell its invention or license it in order to obtain profit. By selling it you will lose all your rights on it. However, using the license system helps the inventor obtain a part of the selling made by a certain company. People can also obtain benefits from trademarks, but this is only made through advertisement since trademarks are one of the most important marketing tools for companies.

In patent, you seek to obtain a patent and claim it. Primarily, you need to present a written description of your discovery. The description must de detailed. The inventor must describe the uses of his discovery. Most importantly, the inventor must provide specifications of your discovery such as how it was made and how it will be operated. The written description is termed as "patent specification."

If you need an application form to register your trademark, you can download one from the USPTO site or go personally at their office. With the application form the company has to also submit images and designs of their mark. Don't forget to include a description of the products sold by the company or a description of the services it provides.

Both patent and trademark application has its corresponding filing fees. The approval of patent and trademark is being managed by the United States Patent and Trademark Office (USPTO). There are people or institutions who can help you deal with your patent or your trademark registration. For instance "The Investors Assistance Center" is an agency which can help you with topics concerning patent. On the other hand, a professional lawyer who specializes in federal trademark may be of help on your queries about trademark registration.

The idea of an individual may it be in the form of an invention or simply a signage is an important asset of one's society. Knowing how to properly utilize it as well as take good care of it can hold a lot of benefit not only to the discoverer but to the whole nation as well.
